Terms and Conditions


ELPIDA Education (ELPIDA) provides quality training and assessment to individuals through Registered Training Organisations (RTO) via Recognition of Prior Learning (RPL) based on their knowledge and work experience in diverse sectors. We aim to assist individuals to fulfill their career potential and become a part of the Australian workforce.

In this Policy, references to we, us, or our are references to ELPIDA.


1. About the Website 

1.1. Welcome to  elpidaedu.com (the ‘Website‘). The Website facilitates interactions between:

  • People/students learning about RPL (the ‘Client‘);
  • ELPIDA Education (the ‘Facilitator‘), and
  • Registered Training Organisation (the ‘Provider’)

Making it easier for the Client and the Provider to locate, communicate, and deliver the services in a fast and secure manner (the ‘Services‘).


1.2. The Website is operated by ELPIDA ENTERPRISES PTY LTD. (ABN 52 644 504 487) t/a ELPIDA Education (ELPIDA). Access to and use of the Website, or any of its associated Services, is provided by ELPIDA. Please read these terms and conditions (the ‘Terms‘) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms.

If you do not agree with the Terms, you must cease usage of the Website or any of its products or Services.


1.3. ELPIDA reserves the right to review and change any of the Terms by updating this page at its sole discretion. When ELPIDA updates the Terms, it will use reasonable endeavours to provide you with notice of updates of the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.

2. Acceptance of the Terms
You accept the Terms by registering for the Services as required under the Terms for use of the Services. You may also accept the Terms by clicking to accept or agree to the Terms where and if this option is made available to you by ELPIDA in the user interface.

3. The Services 
3.1. The Services include information about the RPL process, RPL provider information, Qualifications, etc. As a part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:

  • Name
  • Email address
  • Contact Details
  • Employment status
  • Others

3.2. The website does not have a payment mechanism. All payments for Services are made separately to ELPIDA Business Account via EFT or other means as agreed between You and ELPIDA outside the website.

3.3. You warrant that any information you give to ELPIDA will always be accurate, correct and up to date.

3.4. You may not use the Services and may not accept the Terms if:

  • you are not of legal age to form a binding contract with ELPIDA; or
  • you are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services.

4. Your obligations 
4.1. As a Client, you agree to comply with the following:

  • you will use the Services only for purposes that are permitted by:
  1. The Terms; and
  2. any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions;
  • you must not expressly or impliedly impersonate another Member at any time;
  • you will not use the Services or the Website in connection with any commercial endeavours except those that are specifically endorsed or approved by the management of ELPIDA;
  • you will not use the Services or Website for any illegal and/or unauthorised use which includes collecting email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Website;
  • you agree that appropriate legal action will be taken by ELPIDA for any illegal or unauthorized use of the Website; and
  • you acknowledge and agree that any automated use of the Website or its Services is prohibited.

5. Copyright and Intellectual Property
5.1. The Website, and the Services of ELPIDA are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website, code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes and are reserved by ELPIDA.

5.2. All trademarks, service marks and trade names are owned, registered and/or licensed by ELPIDA. Whilst you are using the Services:

  • use the Website pursuant to the Terms;
  • copy and store the Website and the material contained in the Website in your device’s cache memory; and
  • print pages from the Website for your own personal and non-commercial use.

5.3. ELPIDA does not grant you any other rights whatsoever in relation to the Website or the Services. All other rights are expressly reserved by ELPIDA.

5.4. Nothing you do on or in relation to the Website will transfer any:

  • business name, trading name, domain name, trademark, industrial design, patent, registered design or copyright, or
  • a right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or
  • a thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process),

5.5. You may not, without the prior written permission of ELPIDA broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services for any purpose, unless otherwise provided by these Terms. This prohibition does not extend to materials on the Website, which are freely available for re-use or are in the public domain.

6. Availability of this website 
ELPIDA will try to make this website available but cannot guarantee that this website will operate continuously or without interruptions or is error free and can accept no liability for its unavailability. The Client must not attempt to interfere with the proper working of this website

and, in particular, must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other Internet-connected device.

7. Liability 
7.1 ELPIDA will do its best to ensure that all materials and information published on this website are accurate, but please note that all content materials and information on this website are provided on an ‘as is’ basis and the Client assumes total responsibility and risk for use of this website and use of all information contained within it.

7.2. ELPIDA accepts no liability for any loss or damage whether due to inaccuracy, error, omission or any other cause.

7.3. The Client is responsible for ensuring that his/her computer system meets all relevant technical specifications necessary to use this website and is compatible with this website. The Client also understands that ELPIDA cannot and does not guarantee or warrant that any material available for downloading from this website will be free from infection, viruses and/or other code that has contaminating or destructive properties. The Client is responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy his/her particular requirements for the accuracy of data input and output.


8.0. Data Privacy

8.1. This Policy sets out the minimum requirements for the confidentiality, security, integrity, and protection of the Client’s Personal Information. We may collect Personal Information about you and we are committed to protecting this Personal Information and your privacy. We will take steps that are reasonable in the circumstances to protect your personal information from loss, misuse, interference, unauthorised access, modification, or disclosure.

8.2. As part of your use of our websites, your correspondence with us, from social media platforms, or from third-party, we may collect your personal information which may include:

  • your name;
  • your contact details (email address, telephone and mobile numbers, address, etc.);
  • your educational qualifications;
  • employment status and previous work experience;
  • identity documents;
  • information about your required services; i.e., qualifications you are applying for, etc.

Please note that we do not collect credit card or financial information via the website.

8.3. We collect the above information in order to provide services to you or to inform you of services we may provide to you.

8.4. The processing of Personal Information is necessary for us to meet our legal and regulatory obligations where a regulator requires us to maintain certain records of any dealings with you.

8.5. We may be unable to provide certain services to you if you do not provide the Personal Information requested.

8.6. We will only disclose your Personal Information in accordance with applicable laws and regulations. In some instances, this will include sharing your Personal Information with third parties. This may include:

  • sharing with our employees, RTOs, contractors, mailing and distribution providers
  • our professional advisers (including our accountants, lawyers and auditors), our bank and insurers;
  • In case of transfer of our business, to the new owner of the business;
  • your authorised third party,
  • government agencies including local government councils, courts, regulatory bodies, and law enforcement agencies, or as required, authorised, or permitted by law.

8.7. We generally hold your Personal Information on our systems for as long as is necessary to provide our services to you. The length of time for which we keep your Personal Information will depend on the services we provide to you and their relevant regulatory requirements.

8.8. Use of Cookies – To improve the quality of our websites and services, we or some of our partners may from time to time send a “cookie” to your computer. Cookies are text files that identify your computer to our server and are stored on your device. Cookies in themselves do not identify the individual user, just the computer used. We use cookies to improve your user experience by avoiding the need for you to enter the same information more than once. 8.9. Right to lodge a complaint – You have a right to lodge a complaint to us at any time if you object to the way in which we have used or managed your Personal Information. Where you are dissatisfied with our response, you also have the right to escalate your complaint to the relevant regulator.

9. General
9.1. These terms and  conditions together with the Privacy Policy are the whole agreement between ELPIDA and the Client. The Client acknowledges that it has not entered into this agreement in reliance upon any statement, warranty or representation made by ELPIDA or any other person and irrevocably and unconditionally waives any rights to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) that is not contained in the terms and conditions and the Privacy Policy.

9.2. If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.
